Welcome to Rush Properties (“Rush Properties,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our websites, landing pages, forms, emails, text messages, social media pages, and any services we provide online or offline (collectively, the “Services”). By using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1) Who We Are
Rush Properties is a Florida real-estate company that markets properties, connects buyers and sellers/investors, and provides related information and services. Unless you and Rush Properties sign a separate written agreement stating otherwise, we are not your agent, broker, or fiduciary. Our typical contact information is:

2) Eligibility & Intended Use
You must be at least 18 years old and able to enter a binding contract to use the Services. You may use the Services only for lawful purposes and in compliance with these Terms and applicable federal, state, and local laws and regulations.
3) No Professional Advice; No Agency Created
Information provided through the Services is for general informational and marketing purposes only and is not legal, tax, financial, or investment advice. We encourage you to consult appropriate professionals. Your use of the Services does not create a brokerage, agency, attorney-client, or fiduciary relationship unless a separate written agreement explicitly says so.
4) Property & Market Information
Listings, pricing, repair estimates, rent estimates, after-repair values (ARVs), cap rates, and other figures shared by us or third parties are estimates only and may change without notice. All property information should be independently verified by you and your advisors (e.g., inspections, title search, permitting, zoning, insurance, HOA/condo assessments, flood/ wind/ hazard risks). We make no guarantee of profit, returns, financing, or availability.
If MLS/IDX feeds or third-party data appear on the Services, they are provided “as is,” may be delayed or incomplete, and are subject to the respective providers’ rules. You agree not to copy, scrape, or redistribute such data.
5) Investment & Wholesaling Disclosures (If Applicable)
Some opportunities may be presented by owners, assigns, or wholesalers. Contracts may be assignable, and prices/terms can change. You are responsible for conducting due diligence (including reviewing assignability, liens, violations, HOA rules, special assessments, and required disclosures). Rush Properties is not responsible for defects or inaccuracies provided by sellers or third parties.
6) Equal Housing Opportunity
We support and comply with the Fair Housing Act and all state/local fair housing laws. We will not knowingly publish or engage in discriminatory housing practices. If you believe you have encountered discrimination, please notify us immediately and consult HUD or your local fair housing agency.
7) Communications & Consent to Text/Calls
By submitting a form, calling us, emailing us, or otherwise providing your contact information, you consent to receive communications from us and our service providers, including emails, SMS/MMS text messages, and calls (including via autodialer/automated technology and prerecorded messages) to any number you provide, for transactional and marketing purposes. Message and data rates may apply. Message frequency varies. You can opt out of marketing texts by replying STOP and of marketing emails by using the unsubscribe link. Transactional or account-related messages may still be sent as permitted by law.
8) Accounts, Security & Acceptable Use
If you create an account or portal access, you must provide accurate information, keep your credentials confidential, and promptly notify us of any unauthorized use. You agree not to:
Violate laws or regulations, or infringe others’ rights;
Upload malicious code, scrape, or attempt to reverse engineer the Services;
Interfere with security features or access areas without authorization;
Use the Services to send spam, misleading, or unlawful content.
We may suspend or terminate access for violations of these Terms.
9) Third-Party Links & Tools
The Services may link to third-party websites, tools, lenders, title companies, inspectors, contractors, or other providers. We do not control and are not responsible for third-party content, products, or services. Your dealings with any third party are solely between you and that third party.
10) Intellectual Property
All content and materials on the Services—including text, images, logos, graphics, software, and layout—are owned by or licensed to Rush Properties and protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes. Any other use requires our prior written consent.
If you believe content infringes your rights, contact us with sufficient detail so we can evaluate your claim (e.g., a DMCA-style notice).
11) User Content; Testimonials; License
If you submit reviews, testimonials, comments, images, or other content, you represent that you own or have rights to share it and that it is truthful and lawful. You grant Rush Properties a worldwide, royalty-free, sublicensable license to use, reproduce, display, distribute, and create derivative works from that content in any media for business and marketing purposes, subject to our Privacy Policy.
12) Privacy
Our Privacy Policy explains how we collect, use, and share personal information. By using the Services, you consent to our data practices and to processing in the United States. If you do not agree, please do not use the Services.

14) Disclaimer of Warranties
THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
15) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RUSH PROPERTIES AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM—WHICHEVER IS GREATER.
Some jurisdictions do not allow certain limitations; in those cases, the above limitations apply to the fullest extent permitted.
16) Indemnification
You agree to defend, indemnify, and hold harmless Rush Properties and its owners, officers, employees, agents, and affiliates from and against all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Services; (b) your violation of these Terms or applicable law; or (c) your infringement of any third-party rights.
17) Governing Law; Dispute Resolution; Arbitration
These Terms are governed by the laws of the State of Florida, without regard to conflicts of laws rules. Binding Arbitration & Class-Action Waiver: Except for small-claims matters and claims for injunctive relief, any dispute arising out of or relating to these Terms or the Services will be resolved by binding, individual arbitration under the rules of the American Arbitration Association, conducted in Miami-Dade County, Florida. YOU AND RUSH PROPERTIES WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS OR REPRESENTATIVE ACTION. The arbitrator may award any relief available in court, subject to the limitations in these Terms.
18) International Use
The Services are controlled from the United States and may not be appropriate or available in other locations. You are responsible for compliance with local laws if you access the Services from outside the U.S.
19) Changes to the Services and Terms
We may update, change, or discontinue any part of the Services at any time. We may also modify these Terms from time to time. If we make material changes, we will update the “Last updated” date at the top of this page. Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.
20) Termination
We may suspend or terminate your access to the Services at any time for any reason, including violations of these Terms. Sections that by their nature should survive termination will survive (e.g., intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution).
21) Severability; Entire Agreement; Waiver
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force. These Terms, together with any policies or addenda incorporated by reference (e.g., our Privacy Policy), constitute the entire agreement between you and Rush Properties regarding the Services and supersede any prior or contemporaneous understandings. Our failure to enforce any provision is not a waiver of our right to do so later.
